Greg Connly of DOLAN CONNLY represented a client who was a former MBTA trolley operator and a member of the affiliated Union. She alleged in her lawsuit filed in Suffolk Superior Court that the Union had not advocated for her by failing to take her case to arbitration after she was wrongfully terminated by the MBTA. The client was a native of Haiti and alleged that this failure by the Union to advocate on her behalf, was based on her race and national origin. The client had been the subject of egregious discrimination from some members of the Union.
The trial began on October 29, 2018 in Suffolk Superior Court. The jury found in favor of the client and awarded her $490,500.00 in emotional distress damages. Prejudgment interest of $179,771.19 and statutory costs were added to the verdict bringing the total amount of the judgment to $670,556.19. The Judge then allowed an additional award of attorney’s fees in the amount of $150,000.00 plus $8,733.40 in costs. The total amount of the judgment and fees owed to the client after the Superior Court trial was $829,289.59. The Union then appealed the verdict to the Massachusetts Court of Appeals. The Appeals Court upheld the Superior Court judgment. Further, the Appeals Court awarded attorney’s fees in the Appeals Court case in the amount of $27,355.00. Post-judgment interest that accrued during the appeal was also added.
On November 24, 2020, the Union paid to the client the amount of $1,006,330.03.

Greg Connly of DOLAN CONNLY tried a case in September of 2018 in the Worcester Superior Court. The case alleged chiropractic malpractice. The plaintiff/client was an 81-year-old gentleman who had a manipulation to adjust his pelvis done by the defendant/chiropractor. The negligent performance of this manipulation resulted in the breaking of his prosthetic knee. The client reported that he heard an audible popping sound and felt immediate pain at the time of the adjustment. The prosthetic knee had to be surgically repaired fourteen days later. The chiropractor testified that he had no memory of the treatment and he testified that he did not perform the adjustment described by the client. Greg Connly and Barbara Connly of DOLAN CONNLY worked on the case for over seven years. During the trial, Greg Connly put together the facts and expert testimony supporting the client’s position into a coherent credible case for the jury.

Greg Connly of DOLAN CONNLY tried a case in the Brockton Superior Court in November of 2011. The plaintiff/client was a forty-two-year-old chef working for a third-party food service company at the defendant’s corporate cafeteria. The plaintiff sustained an electric shock when a dishwasher, provided for his use by the defendant, malfunctioned when he pressed the off button on the control panel. The machine was leaking water that came in contact with a live electrical circuit behind the control panel. Working with a hit-and- run accident lawyer at Dolan Connly, P.C. ensures no aspect of your loss is overlooked.
- Medical Expenses: This includes ER visits, surgeries, ambulance fees, follow-up care, physical therapy, and mental health support. If future treatment is required, we calculate and include those projected costs.

- Wrongful Death: If a loved one was killed in a hit and run, surviving family members can seek funeral expenses, loss of support, and emotional damages through a wrongful death action.
When evidence is properly preserved and your claim is approached with a strategic legal plan, Massachusetts law allows for substantial compensation in hit-and-run cases. What to Do Immediately After a Hit-and-Run Accident in Boston, MA
Experiencing a hit and run can be both frightening and disorienting, but swift, organized action is essential to protect your health, preserve critical evidence, and maximize your chances of recovering compensation. Massachusetts law requires prompt reporting of any crash resulting in injury or significant property damage, and your thorough documentation will fuel both law enforcement’s investigation and any uninsured motorist claim you may pursue. If you are able, take the following steps right away:
1. Call 911 and Seek Medical Care
Even if you feel uninjured, some trauma symptoms (like concussions or internal bleeding) may not appear immediately. A 911 call ensures both police and EMTs arrive to document the scene and begin a medical evaluation.
2. Provide a Detailed Police Statement
When officers arrive, relay everything you observed: the fleeing vehicle’s make, model, color, partial or full license plate, direction of travel, and any distinguishing marks or damage. The more precise your description, the better law enforcement’s chances of identifying the driver.
3. Photograph and Video the Scene
Capture multiple angles of your vehicle’s damage, any injuries, skid marks, nearby debris, and road or weather conditions. If you can safely do so, record video of the surrounding area, including storefronts or traffic cameras, that may have captured the vehicle in flight.
4. Collect Witness Information
Bystanders, other drivers, or passengers may have seen details you missed. Ask for their names, phone numbers, and brief written accounts of what they witnessed. Independent witness testimony is often decisive in reconstructing hit-and-run events.
5. Notify Your Insurance Company
Under Massachusetts law, every motorist must carry uninsured/underinsured motorist (UM/UIM) coverage to protect victims of hit and runs. Call your insurer as soon as possible, give them the police report number, and request that your UM claim be opened.
6. Preserve All Evidence
Keep any broken vehicle parts, damaged personal items, and your medical records. Do not discard or repair your car until after an insurer or attorney has had a chance to inspect the damage.
7. Avoid Recorded Statements Without Counsel
Insurance adjusters for both your own carrier and any liable party may seek recorded or written statements. Decline to provide these until you have consulted an attorney, as early statements can be used to minimize your claim.
After a hit-and-run accident, your next steps can significantly influence the outcome of your case. The sooner you involve experienced legal counsel, the better positioned you will be to preserve evidence, identify potential sources of compensation, and protect your rights. At Dolan Connly, P.C., we step in early to manage the legal and investigative burdens, so you can focus on your health while we focus on results.
How Will a Hit-and-Run Accident Attorney at Dolan Connly, P.C. Handle Your Case?
When you have been struck by a driver who disappears, recovering your losses can feel overwhelming. Evidence often vanishes, insurers resist, and the legal maze can be daunting. A Boston hit-and-run attorney must marshal specialized tools and tenacious advocacy on your behalf.
At Dolan Connly, P.C., we reconstruct every element of your crash, turn scattered clues into compelling proof, and deploy Massachusetts law to secure the accountability and compensation you need, even if the at-fault driver remains unidentified.
Reconstructing the Collision
Our attorneys immediately engage accident reconstruction experts and private investigators to piece together what happened. We analyze skid patterns, paint transfers, and vehicle damage; obtain nearby surveillance footage; and collaborate with Boston Police to develop any leads as to the identity of the fleeing driver.
Maximizing Your Insurance Recovery
Under Massachusetts’ uninsured/underinsured motorist statutes, you have protections, yet insurers often undervalue hit-and-run claims. We handle all communications, prepare demand packages with detailed medical and economic evidence, and press insurers for full settlement offers that truly cover your medical bills, lost income, and pain and suffering.
Quantifying Present and Future Needs
Hit-and-run injuries range from whiplash to catastrophic brain trauma. We coordinate with neurologists, rehabilitation specialists, life-care planners, and economists to calculate both immediate treatment expenses and long-term care, home modifications, vocational rehabilitation, and non-economic damages, ensuring every facet of your loss is documented.
Preparing for Litigation Excellence
Even when settlement seems likely, we prepare each case for trial. That means drafting persuasive pleadings, conducting depositions, assembling expert testimony binders, and crafting demonstrative exhibits. This rigorous approach not only equips us for courtroom success but also signals to insurers that only a fair, comprehensive resolution will avoid litigation.
From your first call through the final resolution, Dolan Connly, P.C. provides relentless advocacy and clear communication. We understand that an absent driver doesn’t erase your right to recover. Let our hit-and-run accident attorneys in Boston, MA, convert those missing pieces into a powerful legal claim for your full compensation.
Statute of Limitations for Hit-and-Run Accident Cases in MA
In Massachusetts, you have three years from the date of a hit-and-run accident to file a personal injury lawsuit under M.G.L. c. 260, § 2A. It is crucial to act promptly, as delays can jeopardize your ability to recover compensation. Consulting with a Boston hit-and-run attorney as soon as possible ensures that all legal deadlines are met and that your rights are fully protected.
How Do You File a Hit-and-Run Accident Lawsuit in Boston, MA?
When a hit-and-run driver leaves you injured, the law provides structured avenues to hold someone accountable. Navigating Massachusetts’ personal injury laws, uninsured motorist statutes, and court procedures without counsel can lead to missed deadlines, lost evidence, or undervalued claims. Below is an overview of the legal steps your Boston hit-and-run attorney will take on your behalf.
1. Case Evaluation & Legal Framework
Your attorney will first determine whether your claim should be filed under your own uninsured motorist (UM) coverage or as a lawsuit against the identified driver. We review the details of your policy and apply relevant Massachusetts laws, including the three-year deadline for filing a lawsuit under General Laws Chapter 260, Section 2A.
2. Filing the Complaint & Venue
Once the decision is made, we draft a Complaint that outlines the factual allegations, legal causes of action (negligence, negligent entrustment, etc.), and damages sought. In Boston, these lawsuits are filed in the Suffolk County Superior Court or Boston Municipal Court, depending on the claim’s value and complexity.
3. Service of Process
After filing, we formally serve the defendant following Massachusetts Rules of Civil Procedure, Rule 4. This step ensures that the opposing party/defendant has official notice of the lawsuit.
4. Pre-Trial Motions
Before the case moves forward, either side can ask the court to decide certain issues early. For example, the defense might try to get your case dismissed or limit what damages you can claim. Your attorney will fight these efforts and may also file motions to help establish fault and strengthen your position before trial.
5. Discovery Phase
Discovery allows both parties to exchange evidence. We serve interrogatories, requests for production of documents, and notices of depositions on opposing parties, medical experts, accident reconstructionists, and witnesses. In hit-and-run cases, subpoenas for cell tower records or traffic camera footage providers can be decisive.
6. Settlement Discussions & Mediation
Armed with strategic discovery, we enter settlement negotiations. Your hit-and-run accident attorney will prepare a comprehensive demand package, including medical reports, economic loss calculations, and expert opinions, to secure a fair pre-trial resolution.
7. Trial & Post-Trial Actions
If negotiations stall, we proceed to trial, presenting evidence under the Massachusetts Rules of Evidence. After closing arguments, a judge or jury determines liability and damages. Should the outcome warrant it, your attorney can file post-trial motions.
From the initial case evaluation through post-trial advocacy, working with a hit-and-run lawyer in Boston ensures strict compliance with legal deadlines, procedural rules, and evidentiary standards. Don’t let the complexities of Massachusetts personal injury law stand between you and the compensation you need. Contact Dolan Connly, P.C. today to secure the expert legal guidance your case demands.

There is a very easy way about her, as these things can be very stressful. She was always right there for any concerns or questions that we had. I would highly recommend her to my friends and family. In July 2022, I worked with Kathleen Allen on a closing and was extremely impressed with her professionalism, honestly, and attention to detail. Her keen eye resulted in the seller extending the trust and preventing a delay in the closing. -Sam Excellent service ! Barry McIsaac was prompt and effective in dealing my claim case. We need more attorneys like him to help hold big companies accountable. I’d recommend Barry and the Dolan Connly firm to anyone. I worked with Kathleen Allen to purchase my first home in Boston and she was incredible! FAQ: Boston Hit-and-Run Accident Lawyer
If you have been involved in a hit-and-run accident in Boston and are still looking for information, the answers below address some of the most common concerns regarding such cases. If your situation is more complex or you need additional information, contact a Boston hit-and-run accident lawyer at Dolan Connly, P.C. today and take the first step toward protecting your rights.
Can I sue my own insurance company if they deny my uninsured motorist claim after a hit-and-run accident?
Yes, if your insurer wrongfully denies or undervalues your uninsured motorist (UM) claim, you have the right to challenge their decision. Massachusetts law requires insurers to act in good faith and fairly evaluate claims. An experienced attorney can review your policy, gather evidence, and if necessary, file a lawsuit against your insurer for breach of contract or bad faith in the handling of your claim.
What if I was partly at fault for the hit-and-run accident?
Massachusetts follows a comparative negligence system, which means your compensation may be reduced in proportion to your degree of fault at trial. For example, if you are found 20% responsible, your damages award would be reduced by that percentage. However, even if you share some fault, you can still recover compensation if you are less than 50% at fault at trial. Your lawyer will help demonstrate your limited liability and maximize your recovery.
Are there special considerations if the hit-and-run accident involved a pedestrian or cyclist?
Pedestrians and cyclists are vulnerable road users, and crashes often result in severe harm. While the same UM statutes apply, their injuries typically warrant higher damage awards given the catastrophic nature of injuries sustained. An attorney experienced in these cases will leverage medical and rehabilitation evidence to fully document the unique impacts on mobility and independence.
Can a hit-and-run driver be prosecuted criminally even if I pursue a civil claim?
Absolutely. A hit-and-run incident is a criminal offense in Massachusetts and law enforcement may pursue charges independently of any civil lawsuit. You can pursue a civil claim for compensation regardless of whether the driver is criminally charged or convicted. However, a criminal conviction can strengthen your civil case by establishing fault.
How do insurance companies investigate hit-and-run claims?
Insurance companies will conduct their own investigations which may include reviewing the police report, analyzing accident scene photos, interviewing witnesses, and sometimes hiring private investigators. They may also scrutinize your statements closely. Having an attorney on your side helps ensure that the insurer’s investigation is fair and that your rights are protected during this process.
What happens if the hit-and-run driver has no insurance and no assets?
When the driver remains unidentified or has no assets, your UM coverage is your primary remedy. In addition, Massachusetts operates a Crime Victim Compensation (CVC) program under the Executive Office of Public Safety & Security, which can reimburse medical expenses and lost wages for qualifying hit-and-run victims.
If the hit-and-run driver is caught after I settle with my insurance company, can I still sue them?
Generally, once you settle your claim with your insurer, you waive the right to pursue further compensation related to that accident. However, some settlements include “reservation of rights” clauses or provisions that allow further action if the driver is later identified. It is always advised to consult an attorney before settling to understand your options fully.
