Greg Connly of DOLAN CONNLY represented a client who was a former MBTA trolley operator and a member of the affiliated Union. She alleged in her lawsuit filed in Suffolk Superior Court that the Union had not advocated for her by failing to take her case to arbitration after she was wrongfully terminated by the MBTA. The client was a native of Haiti and alleged that this failure by the Union to advocate on her behalf, was based on her race and national origin. The client had been the subject of egregious discrimination from some members of the Union.
The trial began on October 29, 2018 in Suffolk Superior Court. The jury found in favor of the client and awarded her $490,500.00 in emotional distress damages. Prejudgment interest of $179,771.19 and statutory costs were added to the verdict bringing the total amount of the judgment to $670,556.19. The Judge then allowed an additional award of attorney’s fees in the amount of $150,000.00 plus $8,733.40 in costs. The total amount of the judgment and fees owed to the client after the Superior Court trial was $829,289.59. The Union then appealed the verdict to the Massachusetts Court of Appeals. Greg Connly represented the client during the entire appeal process. On August 4, 2020, a decision came down from the Massachusetts Appeals Court. The Appeals Court upheld the Superior Court judgment. Further, the Appeals Court awarded attorney’s fees in the Appeals Court case in the amount of $27,355.00. Post-judgment interest that accrued during the appeal was also added.
On November 24, 2020, the Union paid to the client the amount of $1,006,330.03.
This case that was handled by Attorney Greg Connly of DOLAN CONNLY went from one on the verge of dismissal, to one in which there was a recovery in excess of a million dollars. No settlement offer had ever been made by the Union prior to the Superior Court trial.

Greg Connly of DOLAN CONNLY tried a case in September of 2018 in the Worcester Superior Court. The case alleged chiropractic malpractice. The plaintiff/client was an 81-year-old gentleman who had a manipulation to adjust his pelvis done by the defendant/chiropractor. The negligent performance of this manipulation resulted in the breaking of his prosthetic knee. The client reported that he heard an audible popping sound and felt immediate pain at the time of the adjustment. The prosthetic knee had to be surgically repaired fourteen days later. The chiropractor testified that he had no memory of the treatment and he testified that he did not perform the adjustment described by the client. Greg Connly and Barbara Connly of DOLAN CONNLY worked on the case for over seven years. During the trial, Greg Connly put together the facts and expert testimony supporting the client’s position into a coherent credible case for the jury.

Greg Connly of DOLAN CONNLY tried a case in the Brockton Superior Court in November of 2011. The plaintiff/client was a forty-two-year-old chef working for a third-party food service company at the defendant’s corporate cafeteria. The plaintiff sustained an electric shock when a dishwasher, provided for his use by the defendant, malfunctioned when he pressed the off button on the control panel. The machine was leaking water that came in contact with a live electrical circuit behind the control panel. Steps to Take Immediately After a Motorcycle Accident
After a motorcycle crash, every minute counts for both your health and your legal case. While you focus on recovery, taking strategic steps right away can preserve critical evidence and strengthen your claim. If you are able, try to do the following:
1. Prioritize Medical Care
Even if injuries seem minor, prompt medical attention is essential. Some conditions may not show symptoms immediately, and medical documentation is key to proving the seriousness of your injuries.
2. Notify Authorities Promptly
Call 911 and ensure a police report is filed. Accurate reporting creates an official record and provides details your motorcycle accident attorney in Braintree can use to establish liability.
3. Document the Scene
If you are physically able, take photos or videos of vehicle positions, skid marks, road conditions, traffic signs, and visible injuries. Collect contact information from witnesses, which can be invaluable if fault is disputed.
4. Contact a Lawyer in Braintree
Critical evidence such as black box data, witness statements, and traffic camera footage can disappear fast. Your attorney acts immediately to secure and preserve all evidence, negotiate with insurers, and guide your case toward the full compensation you deserve.
5. Limit Insurance Communication
Exchange basic contact and insurance information, but do not admit fault or discuss the accident with other parties. Even casual remarks can be misinterpreted and used against you later. Let your Braintree motorcycle accident lawyer handle all communications.
6. Preserve Evidence
Keep damaged gear, personal property, and records of repairs. Save any digital communications related to the accident. These items can provide crucial proof when evaluating your claim.
Getting us involved early allows your motorcycle accident attorney to preserve crucial evidence, interview witnesses while memories are fresh, and investigate every angle of liability. Engaging our team early prevents insurers from leveraging delays and positions your case for the best outcomes.
How a Braintree Motorcycle Accident Lawyer Will Handle Your Case
Motorcycle accidents can involve multiple vehicles, shared liability, and evidence that disappears fast. Acting early, your attorney secures police reports, medical records, witness statements, and data from your motorcycle’s event recorder.
We review traffic camera footage, check road maintenance and construction records, and investigate other potential sources of evidence, including third-party drivers and rideshare involvement. By collecting and analyzing this information promptly, we prevent gaps that could weaken your claim.
Quantifying All Your Losses
We go beyond medical bills to evaluate lost wages, reduced earning capacity, rehabilitation costs, and the long-term impact on mobility and lifestyle. Collaborating with accident reconstruction specialists, medical experts, and vocational consultants, we calculate the full financial and personal impact of your injuries.
Managing Insurance and Legal Strategy
Insurance companies often try to undervalue motorcycle accident claims. We handle all communications, prepare evidence-based settlement demands, and anticipate counterarguments. Every case is also trial-ready, giving you leverage in negotiations and ensuring protection if litigation becomes necessary.
By involving a Braintree motorcycle accident lawyer early, you gain professional handling of your entire case, from securing critical evidence and filing the lawsuit to managing discovery, negotiating with insurance companies, and preparing for trial if necessary. Every step is carefully coordinated to protect your rights and secure maximum compensation.
Statute of Limitations in Massachusetts
The statute of limitations in Massachusetts provides motorcycle accident victims with a limited timeframe to file a personal injury lawsuit. You have three years from the date of the crash to initiate legal action. Missing this deadline means losing the right to recover compensation.
Your motorcycle accident attorney in Braintree acts quickly to safeguard your claim, ensuring that evidence such as police reports, medical records, and witness statements, is secured before it disappears. We handle deadlines, legal filings, and all other procedural requirements.
How Do You File a Motorcycle Accident Lawsuit?
From the moment you and your lawyer decide to move forward, every action is aimed at protecting your rights, preserving evidence, and positioning your claim for the rightful compensation. Here is what happens after you decide to file a motorcycle accident lawsuit in Braintree.
1. Drafting and Filing Your Complaint
We start by writing the official complaint. It lays out precisely what happened, who is responsible, and the damages you are seeking. Filing it with the proper Massachusetts court officially starts your case and sets the legal clock in motion.
2. Serving the Complaint
Next, the defendant(s) must be formally served with the complaint and a summons. Proper service ensures that the other party is legally notified of the lawsuit and allows your case to proceed without delays or procedural issues. The defendant has a set period to respond, usually by filing an answer or other responsive pleading. Your lawyer reviews their response to identify admissions, denials, or defenses that may affect strategy.
3. Discovery
Next comes discovery, where every relevant detail is uncovered. We collect police reports, medical records, maintenance logs, traffic camera footage, and witness statements. We work with accident reconstruction specialists and medical experts to make sure nothing is overlooked.
4. Settlement Negotiations
Many cases settle before trial. Your motorcycle accident lawyer uses the evidence collected in discovery to negotiate compensation with insurers or opposing counsel. These negotiations are informed, precise, and aim to reflect both economic and non-economic damages.
5. Trial Preparation
If a fair settlement cannot be reached, your case is prepared for trial. This includes organizing evidence, preparing witnesses, and strategizing arguments to present a compelling case to the jury or judge.
6. Trial and Verdict
During the trial, both sides present evidence and arguments. Your attorney advocates for your full recovery, ensuring the jury or judge understands the impact of your injuries and losses.
Filing a motorcycle accident lawsuit in Braintree is a detailed and technical process that requires precision at every step. With an attorney by your side, every filing, deposition, and negotiation is handled strategically to protect your rights and maximize your recovery.
Client Testimonials
The legal council I received from DOLAN CONNLY starting with the initial office visit to the settlement of my personal injury case was very helpful when I needed it most. They helped me navigate all the options and told me in plain English what to expect. I was a cooperative client and provided them with all the documentation they required and was patient allowing the legal process to unfold all of which they appreciated. Given the extent of damages I incurred from the accident I was pleased with the total compensation I received.
Kathleen Allen has been our attorney for a few properties and we have sold and have been very happy and satisfied with her professional care in these transactions. There is a very easy way about her, as these things can be very stressful. She was always right there for any concerns or questions that we had. I would highly recommend her to my friends and family.
I have closed on two houses with DOLAN CONNLY in the past 10 years. In July 2022, I worked with Kathleen Allen on a closing and was extremely impressed with her professionalism, honestly, and attention to detail. She was the only party to notice a trust was expiring weeks before the planned closing date. Her keen eye resulted in the seller extending the trust and preventing a delay in the closing.

I worked with Kathleen Allen to purchase my first home in Boston and she was incredible! The seller and I were not working with real estate agents, but Kathleen went above and beyond to make the closing process smooth. I was able to close on time due to her advocating and watching over me. I could not have bought this home without her help. I highly recommend anyone looking for a knowledgeable, quick, and advocating attorney to contact her to purchase a home.

Frequently Asked Questions
Motorcycle accidents in Braintree can be complicated, and victims often have pressing questions about their rights, claims, and potential compensation. Motorcycle accident lawyers at DOLAN CONNLY, P.C., have answered some of the most common questions we receive.
Can I recover compensation if the at-fault driver is uninsured in Braintree?
Yes. If the driver responsible for your accident does not have insurance or has insufficient coverage, you may still recover compensation through your own uninsured or underinsured motorist coverage. A Braintree motorcycle crash attorney will evaluate your policy, identify all potential sources of recovery, and ensure that you pursue the maximum available compensation.
How do Massachusetts helmet laws affect my motorcycle accident claim?
In Massachusetts, all motorcycle operators and passengers are legally required to wear a Department of Transportation (DOT) approved helmet. This mandate is outlined in Massachusetts General Laws Chapter 90, Section 7. Failure to comply can result in fines and potential increases in insurance premiums. Beyond legal compliance, the absence of a helmet can influence the outcome of a personal injury claim.
In cases where head or neck injuries are involved, the lack of a helmet may be used by the defense to argue that the injuries were more severe than they would have been had a helmet been worn. This could lead to an increased percentage of fault assigned to the rider, thereby reducing the potential compensation. Given these complexities, it is important to consult with a motorcycle accident attorney in Braintree who can assess the specifics of your case.
How is fault determined in a motorcycle accident in Braintree?
Massachusetts follows a modified comparative negligence system. Each party is assigned a percentage of fault, and your compensation awarded at trial is reduced accordingly. If you are found to be 50% or more at fault during a trial, you cannot recover damages. Your motorcycle accident lawyer reviews police reports, witness statements, accident reconstruction data, and other evidence to accurately establish liability and protect your claim.
What should I do if I am involved in a hit-and-run motorcycle accident in Braintree?
Hit-and-run accidents can be complex, particularly when the other driver cannot be identified. Contact an attorney who will help you pursue compensation through your own insurance, collect witness statements, and work with law enforcement to track down the responsible party. Expert guidance ensures that your claim accounts for medical expenses, lost wages, property damage, and long-term impacts.
Can I file a motorcycle accident claim involving a rideshare or delivery vehicle?
Yes, however, accidents with rideshare or delivery vehicles involve multiple layers of insurance, including personal and commercial coverage. A motorcycle accident lawyer can navigate these complexities, identify all responsible insurers, and pursue compensation for your injuries, property damage, and any long-term consequences.
How much does it cost to hire a motorcycle accident lawyer in Braintree?
At DOLAN CONNLY, P.C., we handle motorcycle accident cases on a contingency fee basis. You pay nothing upfront, and our attorneys only receive a fee if we recover compensation for you. This allows you to pursue justice without financial risk while ensuring that your case is managed by experienced legal professionals.
