Greg Connly of DOLAN CONNLY represented a client who was a former MBTA trolley operator and a member of the affiliated Union. She alleged in her lawsuit filed in Suffolk Superior Court that the Union had not advocated for her by failing to take her case to arbitration after she was wrongfully terminated by the MBTA. The client was a native of Haiti and alleged that this failure by the Union to advocate on her behalf, was based on her race and national origin. The client had been the subject of egregious discrimination from some members of the Union.
The trial began on October 29, 2018 in Suffolk Superior Court. The jury found in favor of the client and awarded her $490,500.00 in emotional distress damages. Prejudgment interest of $179,771.19 and statutory costs were added to the verdict bringing the total amount of the judgment to $670,556.19. The Judge then allowed an additional award of attorney’s fees in the amount of $150,000.00 plus $8,733.40 in costs. The total amount of the judgment and fees owed to the client after the Superior Court trial was $829,289.59. The Union then appealed the verdict to the Massachusetts Court of Appeals. Greg Connly represented the client during the entire appeal process. On August 4, 2020, a decision came down from the Massachusetts Appeals Court. The Appeals Court upheld the Superior Court judgment. Further, the Appeals Court awarded attorney’s fees in the Appeals Court case in the amount of $27,355.00. Post-judgment interest that accrued during the appeal was also added.
On November 24, 2020, the Union paid to the client the amount of $1,006,330.03.
This case that was handled by Attorney Greg Connly of DOLAN CONNLY went from one on the verge of dismissal, to one in which there was a recovery in excess of a million dollars. No settlement offer had ever been made by the Union prior to the Superior Court trial.

Greg Connly of DOLAN CONNLY tried a case in September of 2018 in the Worcester Superior Court. The case alleged chiropractic malpractice. The plaintiff/client was an 81-year-old gentleman who had a manipulation to adjust his pelvis done by the defendant/chiropractor. The negligent performance of this manipulation resulted in the breaking of his prosthetic knee. The client reported that he heard an audible popping sound and felt immediate pain at the time of the adjustment. The prosthetic knee had to be surgically repaired fourteen days later. The chiropractor testified that he had no memory of the treatment and he testified that he did not perform the adjustment described by the client. Greg Connly and Barbara Connly of DOLAN CONNLY worked on the case for over seven years. During the trial, Greg Connly put together the facts and expert testimony supporting the client’s position into a coherent credible case for the jury.
On September 14, 2018, the Worcester Superior Court jury came back with a verdict in favor of the plaintiff/client. DOLAN CONNLY’S client was awarded $750,000.00 in past and future medical expenses and $3,000,000.00 in pain and suffering. Including interest, the total judgment was $4,426,180.35. Greg Connly of DOLAN CONNLY tried a case in the Brockton Superior Court in November of 2011. The plaintiff/client was a forty-two-year-old chef working for a third-party food service company at the defendant’s corporate cafeteria. The plaintiff sustained an electric shock when a dishwasher, provided for his use by the defendant, malfunctioned when he pressed the off button on the control panel. The plaintiff suffered a traumatic brain injury, major depression, panic disorder, cognitive impairment and post-traumatic stress disorder. Following the electric shock, the plaintiff who had received excellent work reviews over the years, struggled at his job due to the effects of the traumatic brain injury. What to Do After a Personal Injury in Brockton
If you have been injured in Brockton because of another party’s careless or wrongful actions, the steps you take in the hours and days that follow are critical, not only for your health and recovery, but also for protecting your legal rights.
At Dolan Connly, P.C., we guide clients through this difficult time with clarity and purpose, ensuring no important detail is overlooked.
- Prioritize Medical Attention: Even if your injuries seem minor, seek medical evaluation as soon as possible. Delayed treatment can not only worsen your condition but may also complicate your legal claim.
- Report the Incident: Notify the appropriate parties, such as law enforcement, a property owner, or an employer, depending on the nature of the accident. A formal report helps establish the circumstances of the incident.
- Preserve Evidence: If you are able, take photographs of the scene, your injuries, and any property damage. Collect names and contact information of witnesses, and retain all medical records, bills, and related documentation.
- Avoid Discussing the Case with Insurance Companies: Insurance representatives may reach out quickly to settle your claim or obtain a statement. Refrain from speaking with them directly until you have consulted with legal counsel.
- Contact a Personal Injury Attorney in Brockton: The sooner you speak with an experienced attorney, the better positioned you are to protect your rights and build a strong claim. At Dolan Connly, P.C., we provide strategic guidance and unwavering advocacy from the very beginning.

How Will a Brockton Personal Injury Attorney at Dolan Connly, P.C. Handle Your Case?
After a serious injury, trying to manage the legal aftermath on your own can be overwhelming. Between medical appointments, missed work, and mounting expenses, the pressure quickly adds up. Insurance companies may pressure you to settle early, often for far less than your claim is worth.
Without legal guidance, it is easy to make decisions that unintentionally harm your case. That is why having a personal injury attorney by your side is not just helpful—it is essential.
Comprehensive Investigation
We conduct a detailed investigation tailored to the type of accident you experienced. For motor vehicle incidents, this includes securing police reports, reviewing traffic and surveillance footage, consulting with reconstruction experts, and interviewing witnesses. In workplace or premises liability cases, we examine equipment maintenance logs, building code compliance, and corrective action reports. Gathering precise evidence early often strengthens cases in settlement negotiations and court.
Medical Documentation and Claim Preparation
Next, we compile every aspect of your medical history and treatment into a thorough demand package, which includes medical records, bills, proof of lost income, and the impact on your daily life. This provides a clear, evidence-based picture of both your physical and financial losses and contributes to effective negotiation.
Insurance Negotiations
Armed with a comprehensive demand package, we handle all communication with insurance companies. Our strategy anticipates typical tactics—delaying responses or minimizing claims—and ensures Brockton residents receive strong settlement offers rooted in documented evidence. Our goal is to negotiate a fair settlement without the need for litigation.
Strategic Trial Readiness
If the insurance company refuses to offer full compensation, we will take your case to court. We prepare and file a Complaint, manage discovery including depositions and expert evidence, and develop persuasive trial strategies. Though most cases settle, our trial-ready stance ensures insurers take your claim seriously.
Client-Centered Support Throughout
Throughout the entire process, we keep you informed and involved—from case updates and strategy discussions to explanations of legal options and settlement decisions. We place your well-being at the center of our approach, managing legal stress so you can focus on healing.
You don’t have to face this process alone. Personal injury claims can be complex and emotionally exhausting, especially when you are already trying to recover. Having a Brockton personal injury lawyer on your side means you can focus on healing while we focus on securing the outcome you deserve.
Statute of Limitations for Personal Injury Lawsuits in Massachusetts
In Massachusetts, and therefore in Brockton, most personal injury lawsuits must be filed within three years of the date you were injured under M.G.L. c. 260, § 2A. This means that once the date of the event causing your injury passes, you have three years to file litigation in court.
Missing the filing deadline means losing the right to pursue compensation, no matter how clear or significant the injury and loss. Evidence can vanish, witness memories fade, and available legal remedies disappear. For Brockton residents, acting promptly is critical. Consult a Brockton personal injury attorney at Dolan Connly, P.C. as soon as possible so we can ensure all legal deadlines are met and your rights are fully protected.
How Do You File a Personal Injury Lawsuit in Brockton, Massachusetts?
Understanding the technical steps involved in filing a personal injury lawsuit in Brockton, Massachusetts, can help ensure your rights are protected and your claim is handled properly.
Initial Case Assessment and Legal Strategy
After your initial consultation, your attorney will closely assess the specifics of your case. Massachusetts follows a modified comparative negligence rule, so your compensation may be reduced if you are found to be partly at fault at trial, as long as your share of fault does not exceed 50%. Your lawyer will advise you on this evaluation and help establish liability.
Evidence Collection and Demand Preparation
Before filing a lawsuit, our team rigorously investigates all relevant facts. We obtain police reports, medical records, witness statements, photos or videos from the scene, and expert analyses like accident reconstruction, if needed. Once we have a comprehensive record of your injuries and damages, we prepare a detailed demand package to present to insurers. This demand outlines your injuries and losses, and monetary expectations, supported by clear evidence and documentation.
Filing the Complaint
If settlement attempts fail, your attorney drafts and files a Complaint in court. The Complaint lists the parties involved, outlines the factual allegations, explains how the defendant’s actions caused your injuries, and specifies the compensation requested. Once filed, the Complaint and Summons must be properly served on the defendant.
Discovery and Pretrial Phase
After the defendant responds, the discovery phase begins. Both sides exchange documents, answer written interrogatories (questions), and take depositions. This phase allows each party to fully understand the other’s case and gather evidence for trial preparation. During this stage, lawyers may also argue pretrial motions, request expert witness disclosures, and prepare for settlement discussions or mediation.
Negotiation or Trial
Most cases resolve through settlement negotiations before being filed in court. If both parties cannot agree on a resolution, litigation will be filed, and the case will proceed to trial, where a judge or jury will hear the evidence, assess fault, and determine damages.
Enforcement and Appeal
If a judgment is reached, your attorney will handle enforcement and ensure you receive the awarded compensation. In rare instances, either party may appeal the decision if there were legal errors made during the trial.
Filing a lawsuit involves strict procedures, deadlines, and evidentiary requirements. Navigating this system alone can put your case at risk. A Brockton personal injury lawyer at Dolan Connly, P.C. will manage these complexities, protecting your legal rights and ensuring each step is handled accurately and on time.
Brockton Personal Injury Client Testimonials
The legal council I received from Dolan Connly starting with the initial office visit to the settlement of my personal injury case was very helpful when I needed it most. They helped me navigate all the options and told me in plain English what to expect. I was a cooperative client and provided them with all the documentation they required and was patient allowing the legal process to unfold all of which they appreciated. Given the extent of damages I incurred from the accident I was pleased with the total compensation I received. Kathleen Allen has been our attorney for a few properties and we have sold and have been very happy and satisfied with her professional care in these transactions. There is a very easy way about her, as these things can be very stressful. She was always right there for any concerns or questions that we had. I would highly recommend her to my friends and family. I have closed on two houses with Dolan Connly in the past 10 years. In July 2022, I worked with Kathleen Allen on a closing and was extremely impressed with her professionalism, honestly, and attention to detail. She was the only party to notice a trust was expiring weeks before the planned closing date. Her keen eye resulted in the seller extending the trust and preventing a delay in the closing. -Sam Excellent service ! Barry McIsaac was prompt and effective in dealing my claim case. We need more attorneys like him to help hold big companies accountable. I’d recommend Barry and the Dolan Connly firm to anyone. I worked with Kathleen Allen to purchase my first home in Boston and she was incredible! The seller and I were not working with real estate agents, but Kathleen went above and beyond to make the closing process smooth. I was able to close on time due to her advocating and watching over me. I could not have bought this home without her help. I highly recommend anyone looking for a knowledgeable, quick, and advocating attorney to contact her to purchase a home.

FAQ: Brockton Personal Injury Lawyer
If you have suffered an injury in Brockton, it is natural to feel overwhelmed and uncertain about your legal options. To help guide you through the process, we have answered some of the most frequently asked questions about personal injury cases in Massachusetts. For personalized guidance, our legal team in Brockton is always available to speak with you directly.
How do I know if I have a valid personal injury claim in Brockton?
Determining whether you have a valid personal injury claim begins with understanding how the injury occurred and whether someone else’s negligence played a direct role. If another person, business, or entity failed to act with reasonable care and that failure led to your injury, you may have grounds to pursue a claim. The seriousness of your injury is also a factor. Claims often arise when someone experiences not only physical harm but also financial strain, such as medical bills, an inability to work, or emotional trauma. A personal injury attorney in Brockton can assess the facts of your case and help you understand whether legal action is appropriate.
Will my personal injury case in Brockton go to trial?
Many people assume that filing a personal injury case claim means going to court, but in reality, most cases settle before reaching trial. In Brockton and throughout Massachusetts, insurance companies often prefer to resolve claims through negotiation to avoid the cost and uncertainty of litigation.
Still, there are situations where trial becomes necessary, such as when liability is denied or the compensation offered is unreasonably low. When that happens, having an attorney prepared to go the distance is critical. At Dolan Connly, P.C., we prepare every case with trial in mind, even if the goal is a fair settlement.
How long does it take to resolve a personal injury claim in Brockton?
There is no universal timeline for resolving a personal injury claim. Some cases, especially those with clear liability and relatively minor injuries, may settle within a few months. Others, particularly those involving serious injuries or disputed facts, can take longer and may even proceed to litigation.
Much of the timing depends on your medical recovery. It is often unwise to settle until your treatment is complete and the long-term impact of your injuries is known. This allows your attorney to accurately calculate your damages, including future medical needs or lost earning capacity. While a longer timeline can be frustrating, a thorough and well-timed resolution often leads to a better financial outcome.
What should I do if the insurance company denies my claim?
A claim denial from the insurance company doesn’t mean you are out of options. Insurers often deny claims for reasons such as disputed liability or disagreements over the extent of your injuries. The first step after a denial is to have your attorney review the explanation and evaluate the evidence. In many cases, additional investigation, expert opinions, or witness statements can help strengthen your case.
If the insurer still refuses to offer a fair settlement, your personal injury attorney can escalate the matter by filing a lawsuit and pursuing your claim in court.
How can I find the right personal injury attorney in Brockton?
Choosing the right attorney can shape the outcome of your entire case. It is important to work with a lawyer who focuses specifically on personal injury law and understands the unique legal environment in Brockton and Plymouth County. Local experience matters, whether it is knowing how to approach specific insurers, understanding how judges and juries tend to view certain types of claims, or navigating the procedures of the area’s courts.
Beyond experience, look for an attorney who communicates clearly, treats you with respect, and shows a genuine understanding of what you are going through. At Dolan Connly, P.C., we are committed to representing injury victims with skill and compassion, helping you pursue the compensation you need to recover and rebuild.
