Greg Connly of DOLAN CONNLY represented a client who was a former MBTA trolley operator and a member of the affiliated Union. She alleged in her lawsuit filed in Suffolk Superior Court that the Union had not advocated for her by failing to take her case to arbitration after she was wrongfully terminated by the MBTA. The client was a native of Haiti and alleged that this failure by the Union to advocate on her behalf, was based on her race and national origin. The client had been the subject of egregious discrimination from some members of the Union.
The trial began on October 29, 2018 in Suffolk Superior Court. The jury found in favor of the client and awarded her $490,500.00 in emotional distress damages. Prejudgment interest of $179,771.19 and statutory costs were added to the verdict bringing the total amount of the judgment to $670,556.19. The Judge then allowed an additional award of attorney’s fees in the amount of $150,000.00 plus $8,733.40 in costs. The total amount of the judgment and fees owed to the client after the Superior Court trial was $829,289.59. The Union then appealed the verdict to the Massachusetts Court of Appeals. Greg Connly represented the client during the entire appeal process. On August 4, 2020, a decision came down from the Massachusetts Appeals Court. The Appeals Court upheld the Superior Court judgment. Further, the Appeals Court awarded attorney’s fees in the Appeals Court case in the amount of $27,355.00. Post-judgment interest that accrued during the appeal was also added.
On November 24, 2020, the Union paid to the client the amount of $1,006,330.03.
This case that was handled by Attorney Greg Connly of DOLAN CONNLY went from one on the verge of dismissal, to one in which there was a recovery in excess of a million dollars. No settlement offer had ever been made by the Union prior to the Superior Court trial.

Greg Connly of DOLAN CONNLY tried a case in September of 2018 in the Worcester Superior Court. The case alleged chiropractic malpractice. The plaintiff/client was an 81-year-old gentleman who had a manipulation to adjust his pelvis done by the defendant/chiropractor. The negligent performance of this manipulation resulted in the breaking of his prosthetic knee. The client reported that he heard an audible popping sound and felt immediate pain at the time of the adjustment. The prosthetic knee had to be surgically repaired fourteen days later. The chiropractor testified that he had no memory of the treatment and he testified that he did not perform the adjustment described by the client. Greg Connly and Barbara Connly of DOLAN CONNLY worked on the case for over seven years. During the trial, Greg Connly put together the facts and expert testimony supporting the client’s position into a coherent credible case for the jury.
On September 14, 2018, the Worcester Superior Court jury came back with a verdict in favor of the plaintiff/client. DOLAN CONNLY’S client was awarded $750,000.00 in past and future medical expenses and $3,000,000.00 in pain and suffering. Including interest, the total judgment was $4,426,180.35. No offer had ever been made by the defense to settle the case. The verdict was appealed by the defense attorney. The case resolved during the appeal process with the 88-year-old client receiving a significant financial settlement, above and beyond any other comparable Massachusetts settlement or verdict for such injuries. Greg Connly of DOLAN CONNLY tried a case in the Brockton Superior Court in November of 2011. The plaintiff/client was a forty-two-year-old chef working for a third-party food service company at the defendant’s corporate cafeteria. The plaintiff sustained an electric shock when a dishwasher, provided for his use by the defendant, malfunctioned when he pressed the off button on the control panel. The machine was leaking water that came in contact with a live electrical circuit behind the control panel. Greg Connly was able to prove at trial that the defendant corporation was responsible for maintenance of the dishwasher and that it was in a hazardous and unsafe condition. It was discovered that the dishwasher had various mechanical problems after its initial installation and employees of the defendant failed to properly maintain it. The plaintiff suffered a traumatic brain injury, major depression, panic disorder, cognitive impairment and post-traumatic stress disorder. Following the electric shock, the plaintiff who had received excellent work reviews over the years, struggled at his job due to the effects of the traumatic brain injury. He never regained his previous high-level functioning in his occupation and was forced to stop working altogether.
On November 29, 2011, the Brockton Superior Court jury came back with a verdict in favor of the plaintiff/client. DOLAN CONNLY’S client was awarded $2,500,000.00 in past and future medical expenses, pain and suffering, and lost earning capacity. Including interest in the amount of $1,180,187.78, the final award was $3,680,187.78. The last offer by the defendant corporation to settle the case before trial was $50,000.00. The verdict was appealed by the defense, but the judgement was paid in full after the trial transcripts were reviewed by appellate counsel. Click here to see the actual court docket.

What to Do Immediately After a Motorcycle Accident in Pembroke, MA
If you have been involved in a motorcycle accident in Pembroke, the actions you take in the moments after the crash can make a significant difference in your recovery and your case. The aftermath of an accident can be overwhelming, but knowing what to do can help protect your health, safety, and legal rights.
Here are the crucial steps to take immediately after a motorcycle crash:
- Ensure Your Safety – First, make sure you are in a safe location. If you can, move to the side of the road and turn on your hazard lights. If you can’t move due to injury, stay still and wait for emergency assistance.
- Call 911 – Notify the police right away. Calling 911 will ensure that medical help is on the way, and police can document the accident scene, which will be important for your case.
- Seek Medical Attention – Even if you feel fine, it’s important to see a doctor. Motorcycle accident injuries often aren’t immediately apparent, and prompt medical care is vital for your health and your claim.
- Gather Evidence – If you are able, take pictures of the accident scene, your injuries, and any damage to your motorcycle. Be sure to collect contact information from witnesses and other individuals involved.
- Avoid Admitting Fault – Don’t make any statements about the cause of the accident, either to other parties or to insurance companies. Let the police and your attorney determine liability.
- Be Careful with Insurance – Notify your insurance company about the accident, but be cautious about making detailed statements until you have consulted with a lawyer. Insurance companies can sometimes pressure you into settling for less than you deserve.
- Contact a Pembroke Motorcycle Accident Lawyer – As soon as possible, reach out to an experienced motorcycle accident lawyer. Having professional legal help will protect your rights and ensure fair compensation.

Statute of Limitations for Motorcycle Accident Cases in Massachusetts
If you have been injured in a motorcycle accident in Pembroke, MA, it’s crucial to act fast. Under Massachusetts General Law, Chapter 260 § 2A, you have only three years from the date of the accident to file a lawsuit. If you miss this deadline, you lose your right to seek compensation for medical bills, lost income, and pain and suffering—even if the accident wasn’t your fault.
The sooner you take action, the better. Vital evidence can disappear, and witness memories can fade, making it harder to prove your case. Insurance companies often take advantage of delays to minimize or deny claims. That is why you need a knowledgeable Pembroke motorcycle accident lawyer to protect your rights.
At Dolan Connly, P.C., we know how to build a strong case, handle insurance negotiations, and make sure you meet every legal deadline.
How Do You File a Motorcycle Accident Lawsuit in Pembroke, Massachusetts?
A motorcycle accident can be a life-altering event, leaving you with serious injuries, financial strain, and emotional distress. If you or a loved one has been harmed due to someone else’s negligence, the legal system provides a path to seek justice and compensation.
Understanding the process of filing a lawsuit can help you take control of your future and ensure that your rights are protected.
- Seek Legal Guidance Without Delay
In the aftermath of an accident, your focus should be on healing. However, time is of the essence when pursuing a legal claim. Consulting with a Pembroke motorcycle accident lawyer is the first critical step. Your attorney will assess the details of your case, determine liability, and ensure that your claim or lawsuit is filed on time.
- Building a Case Through Evidence and Investigation
A strong case is built on compelling evidence. Your attorney will conduct a thorough investigation, gather police reports, medical records, eyewitness statements, and accident scene photographs. If necessary, expert witnesses—such as accident reconstruction specialists or medical professionals—may be called upon to provide insights that strengthen your claim. This step is crucial in establishing the full extent of your injuries and demonstrating the negligence of the at-fault party.
- Initiating Legal Proceedings
Once your case has been meticulously prepared, your attorney will file a formal complaint in court. This document sets forth the facts of the accident, the legal basis for your claim, and the damages you are seeking. The at-fault party will be formally served with the complaint and given the opportunity to respond. This step marks the official beginning of your pursuit of justice.
- Engaging in the Discovery Process
The discovery phase allows both sides to exchange information and evidence relevant to the case. This may involve written questions, document requests, and sworn depositions. While this process can take time, it is essential in uncovering the truth and ensuring that all facts are presented fairly.
- Pursuing a Fair Settlement
Many motorcycle accident cases are resolved without going to trial. Insurance companies often seek to settle quickly, but their initial offers may not fully account for your medical expenses, lost wages, and long-term suffering. Your attorney will negotiate on your behalf, striving for a settlement that reflects the true impact of your injuries.
- Proceeding to Trial if Necessary
If a reasonable settlement cannot be secured, your case may proceed to trial. In court, both sides will present their arguments, and a judge or jury will determine the outcome. While the prospect of trial can be daunting, a well-prepared case and a dedicated legal team can make all the difference in securing fair compensation.
Dealing with the legal system while recovering from an accident can be daunting, but you do not have to face this journey alone. At Dolan Connly, P.C., we stand beside you with unwavering commitment, ensuring that your voice is heard and your rights are upheld.
If you have suffered a motorcycle accident in Pembroke, reach out to us today for a consultation. Your fight for justice begins with a single step, and we are here to take that step with you.
Pembroke Personal Injury Client Testimonials
The legal council I received from Dolan Connly starting with the initial office visit to the settlement of my personal injury case was very helpful when I needed it most. They helped me navigate all the options and told me in plain English what to expect. I was a cooperative client and provided them with all the documentation they required and was patient allowing the legal process to unfold all of which they appreciated. Given the extent of damages I incurred from the accident I was pleased with the total compensation I received. Kathleen Allen has been our attorney for a few properties and we have sold and have been very happy and satisfied with her professional care in these transactions. There is a very easy way about her, as these things can be very stressful. She was always right there for any concerns or questions that we had. I would highly recommend her to my friends and family. I have closed on two houses with Dolan Connly in the past 10 years. In July 2022, I worked with Kathleen Allen on a closing and was extremely impressed with her professionalism, honestly, and attention to detail. She was the only party to notice a trust was expiring weeks before the planned closing date. Her keen eye resulted in the seller extending the trust and preventing a delay in the closing. -Sam Excellent service ! Barry McIsaac was prompt and effective in dealing my claim case. We need more attorneys like him to help hold big companies accountable. I’d recommend Barry and the Dolan Connly firm to anyone. I worked with Kathleen Allen to purchase my first home in Boston and she was incredible! The seller and I were not working with real estate agents, but Kathleen went above and beyond to make the closing process smooth. FAQ: Pembroke Motorcycle Accident Lawyer
If you have been involved in a motorcycle accident in Pembroke, you may have many questions about the legal process and what steps to take. Below, we have addressed some of the most frequently asked questions regarding motorcycle accident claims in Pembroke. If you need further assistance, our motorcycle accident lawyers at Dolan Connly, P.C. are ready to discuss your case.
What are the most common causes of motorcycle accidents in Pembroke?
Motorcycle accidents in Pembroke are often caused by driver negligence, including distracted driving, failure to yield the right of way, and improper lane changes. Certain roads, such as Route 27 and Route 139, are particularly hazardous due to traffic and limited visibility. Road conditions like potholes, debris, and uneven surfaces also pose significant risks, while poor weather can further reduce visibility. Speeding and impaired driving are common contributors as well.
At Dolan Connly, P.C., we understand the factors that lead to accidents in Pembroke and are dedicated to holding those responsible accountable.
What are the helmet laws in Pembroke, Massachusetts?
In Pembroke, as in the rest of Massachusetts, all motorcycle riders are required by law to wear a helmet. Massachusetts General Laws Chapter 90, Section 7 mandates that both riders and passengers must wear a federally approved helmet while on public roads. Failure to wear a helmet can result in a fine.
However, if you were involved in an accident while not wearing a helmet, it does not automatically bar you from compensation. Massachusetts operates under a comparative negligence rule, meaning your award of damages at trial may be reduced if not wearing a helmet contributed to your injuries, but you may still be entitled to damages.
What are the most common injuries in motorcycle accidents in Pembroke?
Motorcycle accidents often result in serious injuries due to the lack of protection for riders, compared to the protection of those traveling in vehicles. Some of the most common injuries include traumatic brain injuries (TBI), spinal cord injuries, broken bones, road rash, and internal injuries. Serious accidents can also lead to amputations and permanent disabilities.
The severity of these injuries often depends on the nature of the crash and whether the rider was wearing protective gear. If you have been injured in an accident, a Pembroke motorcycle accident attorney can help you assess your injuries and fight for the compensation you deserve.
How long do I have to file a motorcycle accident lawsuit in Pembroke?
In Pembroke, the statute of limitations for filing a motorcycle accident lawsuit is three years from the date of the accident, as set by Massachusetts General Law, Chapter 260 § 2A. However, the sooner you contact a lawyer, the better. Delays in filing could lead to the loss of vital evidence and witnesses. Protect your rights by consulting an attorney as soon as possible after an accident.
Do I need to go to court for my motorcycle accident case?
Most motorcycle accident cases in Pembroke are resolved out of court through negotiations with the insurance company for the negligent party. However, if a fair settlement cannot be reached, your lawyer may advise taking your case to trial. If your case does go to court, you can trust that the legal team at Dolan Connly, P.C. will fight for your rights in front of a judge or jury, ensuring you receive the compensation you deserve.
How is fault determined in a motorcycle accident in Pembroke?
Determining fault in a motorcycle accident in Pembroke involves investigating the circumstances surrounding the crash. Factors such as the police report, witness testimonies, and any available video or photographic evidence are all used to establish who was at fault. Massachusetts follows a comparative negligence system, meaning that if you are partially at fault for the accident, your award of damages at trial will be reduced based on your level of responsibility. A Pembroke motorcycle accident lawyer will help you gather the necessary evidence to prove fault and fight for fair compensation.
What if the other driver doesn’t have insurance?
If the driver who caused the accident does not have insurance or has insufficient coverage, you may still be able to recover damages through your own insurance policy. Massachusetts law requires all drivers to carry Uninsured/Underinsured Motorist (UM/UIM) coverage, which can cover medical bills, lost wages, pain and suffering, and other damages.
Should I accept a settlement offer from the insurance company?
Insurance companies often offer settlements that are far lower than what you may actually be entitled to. Before accepting any offer, it’s crucial to consult with a Pembroke motorcycle accident attorney. A lawyer can evaluate the offer, considering the full extent of your injuries and losses, to determine if it’s fair. Accepting an inadequate settlement may leave you without sufficient compensation for your medical expenses and other costs.
How long will it take to resolve my motorcycle accident case?
The length of time it takes to resolve a motorcycle accident case depends on factors such as the complexity of the case, the severity of the injuries, and whether a settlement is reached or the case goes to trial. While many cases are resolved in a few months, more complicated cases may take longer. At Dolan Connly, P.C., we work diligently to resolve your case as quickly as possible while ensuring your legal rights are protected throughout the process.
How can I find the best motorcycle accident lawyer in Pembroke?
