Greg Connly of DOLAN CONNLY represented a client who was a former MBTA trolley operator and a member of the affiliated Union. She alleged in her lawsuit filed in Suffolk Superior Court that the Union had not advocated for her by failing to take her case to arbitration after she was wrongfully terminated by the MBTA. The client was a native of Haiti and alleged that this failure by the Union to advocate on her behalf, was based on her race and national origin. The client had been the subject of egregious discrimination from some members of the Union.
The trial began on October 29, 2018 in Suffolk Superior Court. The jury found in favor of the client and awarded her $490,500.00 in emotional distress damages. Prejudgment interest of $179,771.19 and statutory costs were added to the verdict bringing the total amount of the judgment to $670,556.19. The Judge then allowed an additional award of attorney’s fees in the amount of $150,000.00 plus $8,733.40 in costs. The total amount of the judgment and fees owed to the client after the Superior Court trial was $829,289.59. The Union then appealed the verdict to the Massachusetts Court of Appeals. Greg Connly represented the client during the entire appeal process. On August 4, 2020, a decision came down from the Massachusetts Appeals Court. The Appeals Court upheld the Superior Court judgment. Further, the Appeals Court awarded attorney’s fees in the Appeals Court case in the amount of $27,355.00. Post-judgment interest that accrued during the appeal was also added.
On November 24, 2020, the Union paid to the client the amount of $1,006,330.03.
This case that was handled by Attorney Greg Connly of DOLAN CONNLY went from one on the verge of dismissal, to one in which there was a recovery in excess of a million dollars. No settlement offer had ever been made by the Union prior to the Superior Court trial.

Greg Connly of DOLAN CONNLY tried a case in September of 2018 in the Worcester Superior Court. The case alleged chiropractic malpractice. The plaintiff/client was an 81-year-old gentleman who had a manipulation to adjust his pelvis done by the defendant/chiropractor. The negligent performance of this manipulation resulted in the breaking of his prosthetic knee. The client reported that he heard an audible popping sound and felt immediate pain at the time of the adjustment. The prosthetic knee had to be surgically repaired fourteen days later. The chiropractor testified that he had no memory of the treatment and he testified that he did not perform the adjustment described by the client. Greg Connly and Barbara Connly of DOLAN CONNLY worked on the case for over seven years. During the trial, Greg Connly put together the facts and expert testimony supporting the client’s position into a coherent credible case for the jury.
On September 14, 2018, the Worcester Superior Court jury came back with a verdict in favor of the plaintiff/client. DOLAN CONNLY’S client was awarded $750,000.00 in past and future medical expenses and $3,000,000.00 in pain and suffering. Including interest, the total judgment was $4,426,180.35. No offer had ever been made by the defense to settle the case. The verdict was appealed by the defense attorney. Greg Connly of DOLAN CONNLY tried a case in the Brockton Superior Court in November of 2011. The plaintiff/client was a forty-two-year-old chef working for a third-party food service company at the defendant’s corporate cafeteria. The plaintiff sustained an electric shock when a dishwasher, provided for his use by the defendant, malfunctioned when he pressed the off button on the control panel. The machine was leaking water that came in contact with a live electrical circuit behind the control panel. Greg Connly was able to prove at trial that the defendant corporation was responsible for maintenance of the dishwasher and that it was in a hazardous and unsafe condition. It was discovered that the dishwasher had various mechanical problems after its initial installation and employees of the defendant failed to properly maintain it. The plaintiff suffered a traumatic brain injury, major depression, panic disorder, cognitive impairment and post-traumatic stress disorder. Following the electric shock, the plaintiff who had received excellent work reviews over the years, struggled at his job due to the effects of the traumatic brain injury. What Damages Can You Recover in a Motorcycle Accident?
The consequences of a motorcycle accident extend far beyond the initial medical bills. With a motorcycle accident lawyer on your side, you can make sure that every economic and non-economic factor is quantified and documented.
Here are the damages you may be able to recover after a motorcycle accident in Plymouth:
- Medical Treatment and Rehabilitation: Compensation includes Emergency Department visits, surgeries, hospital stays, physical therapy, durable medical equipment, and future care expenses.
- Lost Income and Reduced Earning Capacity: Serious injuries can prevent you from returning to work or pursuing your career. We work with financial and vocational experts to estimate both immediate lost wages and long-term impacts.
- Pain, Suffering, and Emotional Distress: Traumatic injuries often cause PTSD, anxiety, depression, and chronic pain. Our attorneys document these impacts thoroughly to ensure non-economic damages are fully reflected.
- Vehicle and Property Loss: Motorcycle repair or replacement, damaged gear, and other personal property are included in your claim.
- Permanent Disability and Scarring: Injuries may result in long-lasting physical limitations, disfigurement, or loss of mobility. Life-care planning specialists help quantify the financial impact.

What Should I Do After a Motorcycle Crash in Plymouth?
We know that after a motorcycle accident, it can be overwhelming to know what to do. Pain, shock, and confusion make it hard to make the right choices, but if you are able, taking certain steps immediately can protect your health, preserve evidence, and strengthen your personal injury claim.
1. Prioritize Your Safety and Seek Medical Care
Move to a safe location if possible and get medical attention. Even minor injuries can worsen. Early treatment not only protects your health but also creates an important record for your claim.
2. Call Emergency Services
Contact 911 to report the accident and request help. The police report documents the crash, and recording the officers’ names and badge numbers helps your attorney later.
3. Document the Scene
Take photos or videos of vehicle positions, skid marks, and road conditions, damage to your motorcycle and other property, and your visible injuries. Collect witness contact information whenever possible, as eyewitness accounts can be vital in proving fault.
4. Share Information Carefully
Exchange basic contact and insurance details with others involved, but avoid admitting fault or making statements about the accident.
5. Limit Insurance Communication
Insurance adjusters may try to settle quickly for less than you deserve. Do not provide statements or sign anything without legal guidance.
6. Contact a Lawyer in Plymouth Quickly
Critical evidence like surveillance footage, black box data, and accident scene conditions can be lost if action is delayed. We move fast to preserve records, gather evidence, and begin building a strong case while you focus on recovery.
Involving a Plymouth motorcycle accident lawyer early is important. Insurance companies often move quickly to limit payouts, and even an offhand comment or misstep can reduce your claim. Contact us promptly to ensure that all communications are handled correctly, evidence is preserved, and your rights are fully protected from the start.
How a Motorcycle Accident Lawyer Protects Your Claim
Determining who is responsible often involves multiple parties, technical traffic analysis, and careful review of medical evidence. Insurance companies are aware of these complexities and are trained to use every minor error against accident victims. Without legal guidance, you risk accepting a settlement that does not fully cover your medical costs, lost income, or long-term needs.
The minute you contact us, a motorcycle accident attorney in Plymouth will take control of the legal process immediately, addressing every detail on your behalf.
Protect Your Statements and Communications
Insurance adjusters often contact accident victims immediately after a crash. They may request recorded statements or written explanations that can later be used to reduce your claim. A lawyer manages all communications to ensure your words are accurate and legally safe.
Gather Evidence Before It Disappears
Critical evidence such as accident scene photos, black box data, or witness statements can be lost or degraded over time. Lawyers know how to secure these details promptly to strengthen your case.
Navigate Complex Liability
Motorcycle accidents can involve multiple vehicles, road defects, or mechanical failures. Lawyers know what evidence and expert testimony are needed to establish fault and protect your rights.
Maximize Your Compensation
A skilled attorney ensures your claim accounts for immediate medical bills, ongoing treatment, lost wages, reduced earning capacity, and non-economic damages such as pain and suffering.
Be Ready for Trial
Even if most cases settle, preparing for litigation from the start improves your negotiating position. Early lawyer involvement ensures that your case is trial-ready if a fair settlement cannot be reached.
Involving a lawyer from the outset gives you a legal advocate who anticipates insurance tactics, preserves crucial evidence, and builds a strong case to secure the full compensation you deserve. Early action is essential to protect your rights and prevent costly mistakes that could affect the outcome of your claim.
Don’t Miss Your Chance to File a Lawsuit
If you have been injured in a motorcycle accident in Plymouth, understanding the legal timeline is critical. Massachusetts law sets strict deadlines for filing personal injury claims, and missing them can permanently bar you from recovering compensation for medical bills, lost wages, pain and suffering, and other damages.
Under Mass. Gen. Laws ch. 260, § 2A, you have three years from the date of the accident to file a lawsuit. This clock starts ticking the moment the crash occurs, not when you realize the full extent of your injuries.
Motorcycle accidents often involve multiple parties, extensive medical records, and technical evidence such as vehicle data or surveillance footage. Delays can result in lost or degraded evidence, faded witness recollections, and missed opportunities to properly document your injuries, all of which insurers may exploit to reduce your claim.
Meeting the statute of limitations is not just a formality. It is essential to protect your rights and achieve maximum results. Contacting an attorney today preserves your options for a fair and comprehensive recovery.
How Do You File a Motorcycle Accident Lawsuit?
Filing a motorcycle accident lawsuit in Plymouth begins the moment you and your attorney decide to pursue legal action. This process is designed to protect your rights, document your damages, and build a strong case for maximum recovery. Understanding the steps ahead helps you feel confident and involved while your lawyer handles the legal complexities.
Step 1: Preparing and Filing the Complaint
Your motorcycle accident attorney will draft a formal Complaint, which outlines the facts of the accident, identifies the parties responsible, and specifies the damages you are seeking. Once filed in court, the Complaint officially starts your lawsuit and notifies the defendant that legal action has been initiated.
Step 2: Serving the Defendant
After filing, the Complaint and a summons are formally delivered to the at-fault party. This step, called “service of process” ensures the defendant is legally aware of the lawsuit.
Step 3: Discovery and Evidence Gathering
Discovery is a critical stage where both sides exchange information. Your lawyer may request medical records, employment history, police reports, witness statements, and any electronic evidence such as black box data. Depositions (formal interviews under oath) may also be conducted with you, witnesses, or experts. You will be guided step by step, so you know exactly what to expect and how to prepare your testimony.
Step 4: Settlement Negotiations
Most motorcycle accident cases are resolved through settlement. Your attorney will use the evidence gathered during discovery to present a detailed demand to the insurance company or opposing counsel. Negotiations involve careful evaluation of your current and future medical needs, lost income, pain and suffering, and other damages. You remain actively involved in evaluating any offers, with your lawyer advising on what is fair and when to push for more.
Step 5: Trial Preparation and Litigation
If a settlement cannot fairly compensate you, your case proceeds to trial. We prepare all evidence, expert testimony, and legal arguments to present your case persuasively before a judge or jury. You will participate in trial preparation, providing testimony and insights into the accident and its impact on your life. Your lawyer ensures that every technical detail, from liability analysis to financial losses, is presented clearly to maximize your recovery.
Step 6: Post-Trial Actions and Appeals
After a verdict, there may be motions to adjust the judgment or an appeal if necessary. Your attorney handles these technical filings, advising you at every step and protecting your rights throughout the post-trial process.
Filing a motorcycle accident lawsuit is a structured but complex process. With a Plymouth motorcycle accident lawyer at your side, you remain informed, prepared, and empowered while our law firm handles the complex technical aspects, insurance negotiations, and litigation strategy to secure the compensation you deserve.
Client Testimonials
The legal council I received from DOLAN CONNLY starting with the initial office visit to the settlement of my personal injury case was very helpful when I needed it most. They helped me navigate all the options and told me in plain English what to expect. I was a cooperative client and provided them with all the documentation they required and was patient allowing the legal process to unfold all of which they appreciated. Given the extent of damages I incurred from the accident I was pleased with the total compensation I received. Kathleen Allen has been our attorney for a few properties and we have sold and have been very happy and satisfied with her professional care in these transactions. There is a very easy way about her, as these things can be very stressful. She was always right there for any concerns or questions that we had. I would highly recommend her to my friends and family. I have closed on two houses with DOLAN CONNLY in the past 10 years. In July 2022, I worked with Kathleen Allen on a closing and was extremely impressed with her professionalism, honestly, and attention to detail. She was the only party to notice a trust was expiring weeks before the planned closing date. Her keen eye resulted in the seller extending the trust and preventing a delay in the closing. -Sam Excellent service ! Barry McIsaac was prompt and effective in dealing my claim case. We need more attorneys like him to help hold big companies accountable. I’d recommend Barry and the DOLAN CONNLY firm to anyone. I worked with Kathleen Allen to purchase my first home in Boston and she was incredible! The seller and I were not working with real estate agents, but Kathleen went above and beyond to make the closing process smooth. I was able to close on time due to her advocating and watching over me. I could not have bought this home without her help. I highly recommend anyone looking for a knowledgeable, quick, and advocating attorney to contact her to purchase a home.

Frequently Asked Questions
Below, we answer common questions about motorcycle accidents in Plymouth. If something here doesn’t quite fit your situation, a motorcycle accident attorney at our firm is ready to discuss your case during a free consultation.
Can I still recover if the other driver doesn’t have insurance?
Yes, but it depends on your coverage. Massachusetts requires drivers to carry insurance, but uninsured drivers exist. If you have uninsured or underinsured motorist coverage, your policy can pay for your injuries and damages. Motorcycle accident claims often involve high medical costs, so having an attorney review your insurance policy early ensures all potential sources of compensation are pursued.
Do helmet laws affect my ability to recover damages?
Massachusetts law requires all motorcycle riders and passengers to wear DOT-approved helmets. If you were not wearing one, insurers may try to reduce your compensation under comparative negligence rules. However, a motorcycle accident attorney in Plymouth can demonstrate that the other driver’s negligence was the primary cause of the crash, and that your injuries would have occurred regardless of helmet use, preserving most of your claim.
How is fault determined in a motorcycle accident?
Massachusetts uses modified comparative negligence. Each party’s share of responsibility is assigned based on evidence such as police reports, witness accounts, and expert reconstructions. If you are found to be 51% or more at fault at trial, you cannot recover. A lawyer begins to collect evidence early to minimize your percentage of fault and protect your right to compensation.
Can I file a claim if a rideshare or delivery vehicle caused my accident?
Yes. Accidents with rideshare or delivery vehicles involve multiple insurance layers, including personal, commercial, and corporate policies. Your motorcycle crash attorney in Plymouth will handle these complexities, identify the liable parties, and ensure your claim covers medical costs, lost wages, ongoing care, and pain and suffering.
How much does it cost to hire a motorcycle accident lawyer?
Our motorcycle accident lawyers in Plymouth work on a contingency fee basis. This means no upfront costs, and attorneys are paid only if they secure a settlement or verdict. You can pursue a claim without financial risk while ensuring expert representation.
How much can I expect to recover from a motorcycle accident?
Settlements depend on the severity of injuries, medical costs, lost income, property damage, and long-term disability. Motorcycle crashes often involve catastrophic injuries, so compensation can range from tens of thousands to millions. Early attorney involvement ensures all damages (both economic and non-economic) are properly documented and valued.
What should I do if I am not able to travel to your office?
If you cannot travel, a motorcycle accident lawyer in Plymouth can meet you at home, in the hospital, or at your rehabilitation facility. Our priority is to provide full legal support while you focus on recovery.
