Greg Connly of DOLAN CONNLY represented a client who was a former MBTA trolley operator and a member of the affiliated Union. She alleged in her lawsuit filed in Suffolk Superior Court that the Union had not advocated for her by failing to take her case to arbitration after she was wrongfully terminated by the MBTA. The client was a native of Haiti and alleged that this failure by the Union to advocate on her behalf, was based on her race and national origin. The client had been the subject of egregious discrimination from some members of the Union.
The trial began on October 29, 2018 in Suffolk Superior Court. The jury found in favor of the client and awarded her $490,500.00 in emotional distress damages. Prejudgment interest of $179,771.19 and statutory costs were added to the verdict bringing the total amount of the judgment to $670,556.19. The Judge then allowed an additional award of attorney’s fees in the amount of $150,000.00 plus $8,733.40 in costs. The total amount of the judgment and fees owed to the client after the Superior Court trial was $829,289.59. The Union then appealed the verdict to the Massachusetts Court of Appeals. Greg Connly represented the client during the entire appeal process. On August 4, 2020, a decision came down from the Massachusetts Appeals Court. The Appeals Court upheld the Superior Court judgment. Further, the Appeals Court awarded attorney’s fees in the Appeals Court case in the amount of $27,355.00. Post-judgment interest that accrued during the appeal was also added.
On November 24, 2020, the Union paid to the client the amount of $1,006,330.03.
This case that was handled by Attorney Greg Connly of DOLAN CONNLY went from one on the verge of dismissal, to one in which there was a recovery in excess of a million dollars. No settlement offer had ever been made by the Union prior to the Superior Court trial.

Greg Connly of DOLAN CONNLY tried a case in September of 2018 in the Worcester Superior Court. The case alleged chiropractic malpractice. The plaintiff/client was an 81-year-old gentleman who had a manipulation to adjust his pelvis done by the defendant/chiropractor. The negligent performance of this manipulation resulted in the breaking of his prosthetic knee. The client reported that he heard an audible popping sound and felt immediate pain at the time of the adjustment. The prosthetic knee had to be surgically repaired fourteen days later. The chiropractor testified that he had no memory of the treatment and he testified that he did not perform the adjustment described by the client. Greg Connly and Barbara Connly of DOLAN CONNLY worked on the case for over seven years. During the trial, Greg Connly put together the facts and expert testimony supporting the client’s position into a coherent credible case for the jury.
On September 14, 2018, the Worcester Superior Court jury came back with a verdict in favor of the plaintiff/client. DOLAN CONNLY’S client was awarded $750,000.00 in past and future medical expenses and $3,000,000.00 in pain and suffering. Including interest, the total judgment was $4,426,180.35. No offer had ever been made by the defense to settle the case. The verdict was appealed by the defense attorney. The case resolved during the appeal process with the 88-year-old client receiving a significant financial settlement, above and beyond any other comparable Massachusetts settlement or verdict for such injuries. Greg Connly of DOLAN CONNLY tried a case in the Brockton Superior Court in November of 2011. The plaintiff/client was a forty-two-year-old chef working for a third-party food service company at the defendant’s corporate cafeteria. The plaintiff sustained an electric shock when a dishwasher, provided for his use by the defendant, malfunctioned when he pressed the off button on the control panel. The machine was leaking water that came in contact with a live electrical circuit behind the control panel. Greg Connly was able to prove at trial that the defendant corporation was responsible for maintenance of the dishwasher and that it was in a hazardous and unsafe condition. It was discovered that the dishwasher had various mechanical problems after its initial installation and employees of the defendant failed to properly maintain it. The plaintiff suffered a traumatic brain injury, major depression, panic disorder, cognitive impairment and post-traumatic stress disorder. Following the electric shock, the plaintiff who had received excellent work reviews over the years, struggled at his job due to the effects of the traumatic brain injury. He never regained his previous high-level functioning in his occupation and was forced to stop working altogether.

What Damages Can You Claim in a Pedestrian Accident Case in Quincy?
After a pedestrian accident, every expense, every setback, and every lost opportunity has a price. Insurance companies will always try to reduce that price, arguing your injuries are temporary, your treatment unnecessary, or your suffering exaggerated. But Massachusetts law allows victims to recover the true cost of their losses, not the insurer’s discounted version. To make that possible, you need a Quincy pedestrian accident attorney who knows what damages are on the table in your personal injury claim.
Here are some of the damages you may be entitled to recover:
- Medical Expenses, Now and Later: From emergency treatment at South Shore Hospital to surgeries, therapy, or long-term care, your pedestrian accident lawyer calculates both current and future medical needs.
- Lost Wages and Reduced Earning Capacity: When injuries prevent you from returning to work or force you into a lower-paying role, you can seek compensation for both lost income and lost earning potential.
- Pain, Suffering, and Emotional Harm: The physical pain is only part of the story. Anxiety, depression, or even the fear of walking near traffic again can take over your life. Massachusetts law recognizes these non-economic losses, and your lawyer will make sure they are given proper weight in your case.
- Loss of Enjoyment of Life: If you can no longer enjoy hobbies, family activities, or the simple pleasure of a walk through Quincy, your settlement should reflect that. We push for compensation that accounts for how much your quality of life has been reduced.
- Wrongful Death: When a pedestrian accident causes the death of a loved one, families have the right to recover funeral expenses, the value of lost support, and compensation for the loss of companionship. At DOLAN CONNLY, P.C., we handle these cases with deep respect and compassion.
The damages available after a pedestrian accident are the foundation for how you rebuild your life. They cover not only the medical care that keeps you on your feet but also the income that supports your family, the counseling that helps you cope, and the stability that allows you to plan for tomorrow. But these rights are not automatic. You have to claim them, prove them, and protect them before critical evidence disappears or deadlines expire.
If you were injured in a pedestrian accident in Quincy, contact an attorney right away. The sooner you act, the stronger your claim and the faster your path to real recovery.
Types of Pedestrian Accident Cases We Handle at DOLAN CONNLY, P.C.

Whether you were hit in a busy crosswalk, clipped in a parking lot, or struck while simply walking your dog in Quincy Center, the law gives you the right to pursue compensation.
But the type of accident you were involved in matters. Each scenario raises different questions of liability, evidence, and legal strategy. Choosing a pedestrian accident lawyer in Quincy who understands those nuances can be the difference between a disappointing settlement and the recovery you actually need.
- crosswalk and intersection collisions
- parking lot and driveway accidents
- school zone and child pedestrian accidents
- drunk or distracted driving cases
- car accidents involving pedestrians
- hit-and-run pedestrian accidents
- accidents involving older adults at busy intersections
- low visibility or weather-related pedestrian accidents
- bicycle and vehicle collisions involving pedestrians
Pedestrian accidents vary widely, and the legal approach must reflect those differences. Each type of case requires different evidence, specialized expert testimony, and a precise application of Massachusetts liability rules. What to Do Immediately After a Pedestrian Accident in Quincy, MA
The first minutes after a pedestrian accident can define your case. Injuries, shock, and confusion make rational decisions difficult, yet the steps you take can determine whether evidence is preserved, liability is established, and your ability to secure full compensation is protected. If you are able, take the following steps to protect your health and rights:
1. Seek Medical Care Without Delay
Even if your injuries feel minor, seek professional medical evaluation immediately. Some injuries, like internal bleeding, concussions, or spinal trauma, may not be obvious at the scene. A timely medical record establishes a direct link between the accident and your injuries, forming the foundation of a strong claim.
2. Preserve Every Critical Piece of Evidence
Photograph the accident scene, vehicle positions, traffic signals, road conditions, and your injuries whenever possible. Collect names and contact information of witnesses. Documenting details immediately prevents degradation of evidence and strengthens both liability and damages arguments.
3. Limit Early Communications
Do not speak to the at-fault driver, their insurance adjuster, or any representatives from other involved parties. Do not sign any forms, provide written statements, or give recorded interviews without your Quincy pedestrian accident lawyer present. Even small errors, offhand comments, or incomplete details can be used to challenge your version of events later.
4. Contact a Pedestrian Accident Lawyer Right Away
A pedestrian accident attorney can issue preservation letters, gather surveillance footage, obtain expert analysis, and coordinate medical and accident reconstruction specialists. Quick legal action positions your claim for maximum compensation.
Every moment after a pedestrian accident in Quincy can shift the balance of your claim. Decisions about what to document, who to speak to, and which experts to involve can determine whether your case stands up to scrutiny or is easily challenged.
Acting without guidance risks overlooking complex liability issues, such as municipal responsibilities for crosswalks, vehicle data from nearby traffic cameras, or multiple party fault. With a pedestrian accident attorney in Quincy, you gain a partner who anticipates these challenges and positions your case for credibility in court.
How Will a Quincy Pedestrian Accident Lawyer at DOLAN CONNLY, P.C. Handle Your Case?
Going it alone after a pedestrian accident can be overwhelming and risky. Missing a single detail, misinterpreting liability rules, or failing to preserve crucial evidence can permanently reduce the compensation you deserve. Every form, statement, and photo matters, and an untrained approach often leaves victims undercompensated while insurance companies exploit gaps in their claims.
A Quincy pedestrian accident lawyer at DOLAN CONNLY, P.C. steps in to ensure nothing is missed and every legal avenue is leveraged on your behalf.
Investigating Every Angle
We obtain official police reports, witness statements, and surveillance footage from traffic cameras or private security cameras near the accident. We analyze roadway conditions, crosswalk signage, and lighting to determine whether municipal factors played a role.
Preserving and Interpreting Critical Evidence
We know exactly how to secure and preserve evidence so it withstands court scrutiny. We collect medical records, medical bills, and employment documentation to ensure your losses are fully captured.
Identifying All Liable Parties
Accidents often involve more than one responsible party. We investigate drivers, property owners, and municipalities to make sure no liable party escapes accountability. Your pedestrian accident attorney in Quincy coordinates with experts like accident reconstructionists or life-care planners to quantify damages with precision.
Negotiation and Trial-Ready Strategy
While many cases resolve through settlement, we prepare each case from day one as if it will go to trial. We will never accept a settlement that doesn’t reflect the full value of your losses.
Full Support, Beyond Paperwork
Your attorney guides you through each step, explaining complex legal options, advocating for proper medical care, and keeping you informed about deadlines and requirements. You are never left navigating a confusing legal process alone.
With DOLAN CONNLY, P.C., your case is positioned for maximum recovery from the very beginning. Every piece of evidence is preserved correctly, and every potential avenue for compensation is pursued aggressively by your pedestrian accident attorney. We fight for your justice while you focus on recovery.
Statute of Limitations for Pedestrian Accident Cases in Massachusetts
Time is not on your side after a pedestrian accident in Quincy. Massachusetts law gives you a strict deadline to file a personal injury lawsuit. Under Massachusetts General Laws Chapter 260, Section 2A, you have three years from the date of the accident to file a lawsuit in court. Missing this window will bar you from recovering any compensation.
The statute of limitations is not just a formality. It is a legal deadline. Acting quickly protects your ability to claim damages for medical expenses, lost wages, pain and suffering, and permanent injuries. With a pedestrian accident attorney guiding you in Quincy, you can focus on healing while your legal team safeguards your case against any procedural missteps.
How Do You File a Pedestrian Accident Lawsuit in Quincy, MA?
Hiring a pedestrian accident lawyer is the moment your case stops being a guessing game and starts being a calculated strategy. Once you retain DOLAN CONNLY, P.C., we take over the complex legal mechanics of filing a personal injury lawsuit in Quincy so you can focus on your recovery, while ensuring every procedural step and piece of evidence strengthens your claim.
Here is an overview of how the process unfolds and what you can expect:
1. Initial Case Assessment and Document Gathering
Within days of your call, your pedestrian accident attorney in Quincy, MA, reviews medical records, accident reports, witness statements, and any photos or video available. We will ask for any documents in your possession, such as medical bills, pay stubs, or accident-related expenses, so nothing critical is missed.
2. Preservation of Evidence
We send formal preservation notices to all parties, request surveillance or traffic camera footage, and coordinate with city or municipal offices for public records. These steps ensure evidence cannot be lost, altered, or destroyed, giving your case a solid foundation.
3. Identifying All Liable Parties
Many pedestrian accidents involve multiple layers of responsibility, including drivers, property owners, or municipalities. Your pedestrian accident lawyer investigates each angle to ensure every party with potential liability is included in the lawsuit.
4. Drafting and Filing the Complaint
The complaint must meet strict Massachusetts procedural rules. Your attorney drafts it to outline your injuries, the defendant’s negligence, and the full extent of your damages, positioning your case to withstand motions to dismiss and lay the groundwork for a meritorious lawsuit.
5. Discovery and Expert Analysis
This phase can take months. This is when we request documents, ask formal questions of opposing parties, depose parties and witnesses, and obtain expert reports (including accident reconstructionists, expert medical assessments, and economic evaluations of lost income). You may be asked to provide detailed information about your daily routines, medical history, and work, all of which helps quantify your losses accurately.
6. Pre-Trial Strategy and Settlement Negotiation
While most cases settle before trial, your pedestrian accident lawyer prepares the case as if it will go to court. This includes expert witness preparation, evidence organization, and legal arguments tailored to maximize your compensation. Settlements are pursued only when they reflect the true value of your injuries, future care needs, and lost earning capacity.
From initial consultation to resolution, pedestrian accident lawsuits in Quincy generally take 9 to 18 months. Complex cases involving multiple parties, serious injuries, or disputed liability may take longer. At every stage, we keep you informed and involved in critical decisions.
When you choose to work with a pedestrian accident attorney at DOLAN CONNLY, P.C., we shield you from procedural pitfalls, ensure all deadlines are met, and position your case for full compensation. Your recovery matters most, and our job is to let you focus on healing while we handle every legal step on your behalf.

In July 2022, I worked with Kathleen Allen on a closing and was extremely impressed with her professionalism, honestly, and attention to detail. Her keen eye resulted in the seller extending the trust and preventing a delay in the closing. -Sam Excellent service ! Barry McIsaac was prompt and effective in dealing my claim case. We need more attorneys like him to help hold big companies accountable. I’d recommend Barry and the DOLAN CONNLY firm to anyone. I worked with Kathleen Allen to purchase my first home in Boston and she was incredible! FAQ: Pedestrian Accident Lawyer in Quincy, MA
If you have been injured while walking in Quincy, MA, you likely have urgent questions about your rights, the claims process, and how to protect yourself. Below are answers to the most frequent questions we hear from pedestrians every day. To receive personalized assistance, please contact our pedestrian accident attorneys today.
How is liability determined in a pedestrian accident in Massachusetts?
Massachusetts follows modified comparative negligence, which means your compensation can be reduced if you are found to be partially at fault at trial. Liability is based on the specific facts of the crash, including driver behavior, pedestrian actions, traffic laws, and road conditions.
A Quincy pedestrian accident attorney examines every detail, such as crosswalk signals, sightlines, traffic camera footage, and witness statements, to accurately assign fault and maximize your recovery.
Do I need a personal injury lawyer if my injuries seem minor?
Yes. Even seemingly minor injuries can worsen over time or require unexpected treatment. Insurance companies may attempt to settle quickly before the full extent of your injuries is known. A Quincy pedestrian accident lawyer at our firm will ensure your claim accounts for future medical needs, lost income, and long-term impacts on your daily life.
What if the driver fled the scene or was uninsured?
Even if the driver leaves or has no insurance, you may be entitled to compensation under your own uninsured or underinsured motorist coverage. Your attorney can guide you through your insurance policy options and, if needed, pursue other liable parties who may be responsible for your pedestrian accident in Quincy.
Will I have to go to court if I decide to file a lawsuit?
Many pedestrian accident cases settle before trial, but not all. If a fair settlement is not possible, your attorney will prepare your case for trial, including gathering expert testimony and accident reconstructions. Preparing for trial from the outset strengthens your negotiating position.
How much does it cost to hire a pedestrian accident lawyer at DOLAN CONNLY, P.C.?
